Basel-Mulhouse-Freiburg Airport
The European Basel-Mulhouse-Freiburg Airport is unique.
It serves three major cities in three different countries: Switzerland, France, and Germany.
Located in Switzerland, Basel is a city of industry and banking, attracting many cross-border workers. On the French side, Mulhouse is the second largest city in Alsace, after Strasbourg. Finally, Freiburg im Breisgau is the capital of the Black Forest, in southwest Germany.
It is the leading airport in the Grand Est region of France. But it also has another distinctive feature: a Franco-Swiss binational operation. It is the only airport in the world with this status.
Your rights at Basel-Mulhouse-Freiburg Airport
Despite its status, a single set of rights applies here: European law.
Although Switzerland is not part of the European Union, it has signed certain European treaties. These include a common framework for civil aviation.
Basel-Mulhouse-Freiburg Airport is governed by European regulation (EC) No. 261/2004. This applies not only to EU Member States but also to Norway, Iceland, and… Switzerland.
What rights does Regulation (EC) No. 261/2004 guarantee you?
Regulation (EC) No. 261/2004 guarantees a number of rights for travellers. These come with obligations for airlines.
The flights covered
The European regulation applies to any flight departing from an airport within the European Community area (including Switzerland, Norway, and Iceland). It also applies to any flight to the same community area, operated by an airline based there.
Not all flights are covered. At Basel-Mulhouse-Freiburg, some flights are operated by airlines based in third countries. These include, among others, Air Algérie, Air Cairo, or Turkish Airlines.
The airlines EasyJet and British Airways are not always subject to EU law, but remain under UK law. Since Brexit, this provides equivalent measures: the UK261 regulation.
The following therefore concerns both European and British law.
The right to reach your destination
If your documents are in order and you arrived on time for boarding, the airline must take you to your destination. In the event of a flight disruption, this obligation remains.
If your flight is cancelled or overbooked, they must offer you an alternative flight. If no satisfactory solution is found, you can request a refund. This means giving up the flight and any other assistance.
The right to expense coverage in case of a long delay
If your flight is significantly delayed, you may need to eat at the airport or even stay overnight. You can request reimbursement for these expenses from your airline. If you need to make phone calls, they must also reimburse you for two calls.
The right to compensation
If your flight is delayed or cancelled, or if you were denied boarding due to overbooking, you may, under certain conditions, claim compensation.
This is a fixed amount, determined by Regulation (EC) No. 261/2004. Depending on the type of disruption and the flight distance, it ranges from €125 to €600.
