Which flights are covered by EC Regulation 261?

EC Regulation 261 aims to compensate passengers who experience flight disruptions (delay, cancellation, or overbooking). Two situations automatically entitle passengers to compensation.

  • Passengers arriving at an airport within the European Union can claim compensation for delays or cancellations, regardless of the airline's nationality or destination.
  • Passengers departing from a non-EU country, but whose final destination and airline are within the European Union.

Is compensation possible in the event of a strike?

EC Regulation 261 allows you to claim compensation if your flight is affected by an airline staff strike.

Note that EC Regulation 261 does not cover airport staff strikes and does not allow for compensation.


Is compensation possible in the event of a flight delay?

If your flight is delayed, you may be entitled to compensation from the airline. The delay must be more than 2 hours at an airport within the European Union.

EC Regulation 261 applies only if the delay is due to specific circumstances (such as a technical fault or operational issue) for which the airline is responsible.


Is compensation possible in the event of a flight cancellation?

In the event of a cancelled flight, you may be entitled to compensation as provided by EC Regulation 261. The cancellation must occur less than 14 days before departure to qualify for compensation. The legislation assumes passengers did not have sufficient time to find an alternative solution.

The airline must offer you an alternative flight or a full refund of your ticket. If you take the alternative flight, your fixed compensation is calculated based on the flight distance and the estimated delay upon arrival. Compensation can be up to €600 per passenger.

Note that to claim compensation, you must not be one of the volunteers who agree not to board.
