EC Regulation 261 provides that passengers whose flights have been disrupted may be entitled to compensation. The disruptions eligible for claims include: 

  • a delay
  • a cancellation
  • overbooking

The amount of your compensation depends on the duration of the journey and the distance travelled.

Below are the different amounts you may be entitled to based on your situation. 

  • For a flight of 1,500 km or less: you may be entitled to €125 for a delay of less than 2 hours or €250 for a delay of 2 hours or more.
  •  For an intra-European Union flight of more than 1,500 km: you may be entitled to €200 for a delay of less than 2 hours or €400 for a delay of 3 hours or more.
  •  For a flight outside the European Union of 1,500 to 3,500 km: you may be entitled to €200 for a delay of less than 2 hours or €400 for a delay of 3 hours or more.
  •  For a flight outside the European Union of more than 3,500 km: you may be entitled to €300 for a delay of less than 2 hours or €600 for a delay of more than 4 hours.

Which flights does EC Regulation 261 cover?

The European Union established EC Regulation 261 to protect and compensate travellers who have experienced a disruption (delay or cancellation). There are two scenarios where the regulation automatically applies.

  • Travellers whose departure airport is located in the European Union can claim compensation for a delay or cancellation, regardless of the airline's nationality or destination.
  •  Travellers arriving from a non-EU country but whose destination and airline are located in the European Union.

Strike at Paris-Charles de Gaulle Airport 

In the event of a strike by airline staff , you can submit a compensation claim as stipulated by EC Regulation 261. Note that only strikes by airline staff entitle you to compensation. If the strike involves airport staff, EC Regulation 261 does not apply


Compensation for a flight delay at Paris-Charles de Gaulle Airport 

If your flight has been delayed, you can submit a refund claim. EC Regulation 261 states that if a delay of more than 2 hours occurs at an EU airport, travellers can request compensation.

EC Regulation 261 covers flights delayed due to specific conditions such as a technical fault or operational issue for which the airline is responsible. "Extraordinary" circumstances do not entitle you to compensation.   


Claiming compensation for a cancelled flight at Paris-Charles de Gaulle Airport 

If you wish to claim compensation following a flight cancellation, certain criteria must be met.

Indeed, EC Regulation 261 only applies if the airline informs you of the cancellation less than 14 days before departure. It assumes that passengers do not have sufficient time to find an adequate solution.

If your flight is cancelled, the airline must offer you an alternative flight or provide a full refund of your ticket. If you choose to take the alternative flight, your flat-rate compensation will be calculated based on the flight distance and the estimated delay at the arrival airport. You may then be eligible for compensation of up to  €600 per traveller. Your compensation depends on the distance travelled and the length of the delay.


Overbooking at Paris-Charles de Gaulle Airport 

Airlines may sometimes overbook or oversell seats, meaning they have sold more seats than available. If you are affected by this practice, you may be entitled to compensation.

Note that you must not be one of the volunteers who agree not to board to claim compensation.

  • The compensation amount depends on the length of the journey. For a flight up to 1,500 km, you may be entitled to a maximum of €250.
  •  For a flight between 1,500 and 3,500 km, you may be entitled to a maximum compensation of €400.
  •  For an EU flight over 3,500 km, the maximum compensation is €400, and €600 for a journey between the EU and a non-EU country.
