Your rights at Luxembourg Airport

The EC 261 regulation was established by the European Union to protect and compensate travellers. If you experience a disruption during your flight, you may be entitled to compensation from the airline. This could be due to a delay, cancellation or overbooking of your flight.

 What compensation can you receive? 

The amount of compensation paid by the airline following a delay, cancellation or overbooking of your flight depends on two factors:

  • The length of the journey
  • The estimated duration of the delay

Below are the compensation amounts you may be entitled to.

  • For a flight of 1,500 km or less: you may be entitled to €125 for a delay of less than 2 hours or €250 for a delay of 2 hours or more.
  • For an intra-European Union flight of more than 1,500 km: you may be entitled to €200 for a delay of less than 2 hours or €400 for a delay of 3 hours or more.
  • For a flight outside the European Union between 1,500 and 3,500 km: you may be entitled to €200 for a delay of less than 2 hours or €400 for a delay of 3 hours or more.
  • For a flight outside the European Union of more than 3,500 km: you may be entitled to €300 for a delay of less than 2 hours or €600 for a delay of more than 4 hours.

Which flights are covered by European law?

The EC 261 regulation allows passengers who have experienced a disruption (delay, cancellation or overbooking) on their flight to be compensated. There are currently two scenarios where the EC 261 regulation applies automatically and allows for compensation from the airline. 

  • Travellers whose arrival airport is located in the European Union can claim compensation in case of a delay or cancellation of a flight, regardless of the nationality of the airline or the destination.
  • Travellers coming from a non-EU country, but whose final destination and airline are located in the European Union.

Strike at Luxembourg Airport

The EC 261 regulation strictly and legally governs the conditions under which a passenger can receive compensation.  Airline staff strikes that disrupt your flight (whether it be a delay, cancellation, or overbooking) allow you to claim compensation.

 Note, the EC 261 regulation does not cover airport staff strikes and does not allow for compensation.

  Compensation for a flight delay at Luxembourg Airport

A flight delay may entitle you to compensation from the airline. However, it is important to meet certain criteria to be eligible for this compensation. The EC 261 regulation states that there must be a delay of more than 3 hours at an EU airport to be compensated.

Note, the EC 261 regulation covers only flights delayed due to specific conditions (a technical fault or operational issue) for which the airline is responsible. Extraordinary circumstances do not allow for compensation claims. 

  Claiming compensation for a cancelled flight departing from Luxembourg Airport

If your flight has been cancelled preventing you from boarding, you may be entitled to compensation from the airline. However, it is important that the cancellation occurs less than 14 days before departure to be eligible for compensation. The legislation considers that travellers have not had sufficient time to find an alternative solution to their flight cancellation.

If your flight is cancelled, the airline must offer you an alternative flight or provide a full refund of your ticket. If you board the alternative flight, your flat-rate compensation is then calculated based on the flight distance and the delay upon arrival. The compensation amount can be up to €600 .

Overbooked flight at Luxembourg Airport: what are your rights? 

 Overbooking or overselling means the airline has sold more tickets than available seats on the plane. In this case, you can make a compensation claim to the carrier.

Note, to be eligible for compensation, you must not be among the volunteers who agree not to board.

  • The compensation amount depends on the journey length. For a flight up to 1,500 km, you may be entitled to a maximum of €250.
  • For a flight distance between 1,500 and 3,500 km, you may be entitled to a maximum compensation of €400.
  • For an EU flight over 3,500 km, the maximum compensation is €400, and €600 for a journey between the EU and a non-EU country.
