Air travel can experience disruptions that may affect your journey. This could be a delay, a cancellation or overbooking. The EC 261 regulation established by the European Union allows passengers affected by a disruption to claim financial compensation.
Compensation amounts
If you have experienced a delay, a cancellation or overbooking on your flight, you can file a claim with the airline to receive compensation. The amount depends on the distance of the journey and its duration.
To help you understand better, below are the compensation amounts you may be entitled to.
- For a flight of 1,500 km or less: you may be entitled to compensation of €125 for less than 2 hours delay or €250 for 2 hours delay or more.
- For an intra-European Union flight of more than 1,500 km: you may be entitled to €200 compensation for less than 2 hours delay or €400 for 3 hours delay or more.
- For a flight outside the European Union of 1,500 to 3,500 km: you may be entitled to €200 compensation for less than 2 hours delay or €400 for 3 hours delay or more.
- For a flight outside the European Union of more than 3,500 km: you may be entitled to €300 compensation for less than 2 hours delay or €600 for more than 4 hours delay.
Which flights are covered by EC Regulation 261/2004?
The EC 261 regulation established by the European Union sets the conditions under which passengers can receive compensation. This regulation applies if your flight departs from Milan airport and/or is operated by an Italian airline.
In case of disruption (delay, cancellation or overbooking), you can file a claim to receive your compensation.
There are two scenarios where the regulation automatically applies.
- If your arrival airport is located in the European Union, you can claim compensation for a delayed or cancelled flight, regardless of the airline's nationality or destination.
- If you are coming from a non-European Union country, but your final destination and airline are located in the European Union.
Strike at Milan airport
Airline staff strikes are among the situations that allow you to claim compensation. If you cannot board or are delayed due to an airline strike, you can file a claim to receive financial compensation. Note, EC 261 regulation does not cover airport staff strikes. In the event of a strike by Milan airport staff, you will not be entitled to compensation.
Compensation for a flight delay at Milan airport
If your flight is delayed, you can file a claim to receive compensation. EC 261 regulation states that if there is a delay of more than 2 hours at an EU airport, passengers on the delayed flight can file a claim.
Please note, the EC 261 regulation indicates that compensation can be claimed if the delay is due to specific conditions. In other words, if it is a technical or operational issue for which the airline is responsible, you can receive compensation. If it is due to extraordinary circumstances, you cannot claim compensation. Request compensation for a cancelled flight at Milan airport
In the event of a cancelled flight at Milan airport, you can file a claim for compensation to offset the inconvenience caused. However, the cancellation must be less than 14 days before the scheduled departure date. The regulation considers that travellers did not have enough time to find an alternative solution following the disruption.
If a flight is cancelled by the airline, they must offer you either an alternative flight or a full refund of your ticket. If you choose to board the alternative flight, your fixed compensation will be calculated based on the flight distance and the estimated delay upon arrival. The compensation amount can be up to €600 per passenger.

Overbooking at Milan airport
During a flight from Milan airport, you may encounter overbooking also known as overselling. This means the airline has sold more tickets than available seats on the plane. If you find yourself in this situation, the EC 261 regulation allows you to claim compensation.
To be eligible for this compensation, you must not be among the volunteers who agree not to board.
- The compensation amount depends on the flight distance. For a flight up to 1500 km, you may be entitled to a maximum of €250.
- For a flight between 1500 and 3500 km, you may be entitled to a maximum compensation of €400.
- For an EU flight over 3500 km, the maximum compensation is €400, and €600 for a journey between the EU and a non-EU country.
